Lic. #01997374), and in Arizona by Pleasant Hill, LLC (AZ Entity Lic. #LC694532000) ("Pleasant Hill," "we," "us" or "our"). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, you shall not use the Site.
1. Using the Site
You may use the Site to look for homes, learn about our services and contact us for your own personal, non-commercial purposes. You shall not:
- copy, scrape, harvest or download listing data, photos or content in bulk, by automated means or otherwise, or republish it on another site or service;
- use the Site or its information to solicit our clients, agents or sellers, or for any commercial purpose other than identifying properties you may be interested in buying or renting;
- submit false, misleading or another person's information, or contact information you do not have the right to use;
- interfere with the Site's security or operation, or try to get around any access limit or protection on it.
2. No agency relationship from using the Site
Using the Site, registering for an account, submitting a form or receiving information from us does not create an agency, fiduciary or broker-client relationship. That relationship begins only when you and Pleasant Hill sign a written agreement (such as a buyer representation or listing agreement) and complete the agency disclosures required by California or Arizona law. Until then, please do not share confidential information you would not want a seller, buyer or other agent to know.
3. Listing information
Listings on the Site are provided in part through the California Regional Multiple Listing Service, Inc. (CRMLS) and other sources. Listing information is provided for consumers' personal, non-commercial use and may not be used for any purpose other than to identify prospective properties consumers may be interested in purchasing. Information is deemed reliable but is not guaranteed, and it should be independently verified, including square footage, lot size, schools, zoning, HOA terms and tax information. Listings may be sold, withdrawn or changed at any time, and some listings held by other brokerages may not appear. Listings held by brokerages other than Pleasant Hill are identified with the listing brokerage's name.
4. Home values, market reports and estimates
Home valuations, price estimates, market snapshots and similar information on the Site or sent to you by us are opinions based on available market data. They are not appraisals, they shall not be relied on as appraisals, and they may differ from what a licensed appraiser or lender determines.
5. Not legal, tax, financial or lending advice
Content on the Site is general information about real estate. It is not legal, tax, accounting, financial or lending advice. Talk with a qualified attorney, tax professional or lender about your situation. Any payment or loan figures shown are illustrations only and are not an offer to lend.
6. Calls, texts and email
When you give us your phone number or email address and agree to be contacted, you agree that we may reach you about your real estate questions, as described in our Privacy Policy. Consent to texts is not a condition of buying or selling. Message and data rates may apply. Reply STOP to stop texts or HELP for help.
7. Fair housing
Pleasant Hill is committed to equal housing opportunity. The Site's text, design, graphics, logos, photos we own and other content belong to Pleasant Hill or its licensors and are protected by copyright and trademark law. Pleasant Hill Real Estate Group's name and logo are our trademarks. Listing photos and descriptions belong to their owners and are used under license. You may view and print pages for your own personal use, but you shall not otherwise copy, modify or distribute our content without our written permission.
9. Links to other sites
The Site may link to websites and services we do not control, such as lenders, escrow and title companies, mapping tools and social media. We are not responsible for their content, accuracy or privacy practices, and a link is not an endorsement.
10. Disclaimer
The Site and its content are provided "as is" and "as available." To the fullest extent the law allows, we make no warranties, express or implied, about the Site, including that it will be accurate, complete, current, uninterrupted or free of errors or harmful components.
11. Limitation of liability
To the fullest extent the law allows, Pleasant Hill and its brokers, agents and staff shall not be liable for any indirect, incidental, special or consequential damages, or for any loss arising from your use of or reliance on the Site or its content. Nothing in these Terms limits any duty we owe a client under a signed written agreement or under applicable real estate law.
12. Indemnity
You shall indemnify and hold harmless Pleasant Hill and its brokers, agents and staff from claims arising from your misuse of the Site or your violation of these Terms.
13. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute about the Site shall be brought in the state or federal courts located in San Bernardino County, California, unless the law where you live requires otherwise.
14. Changes to these Terms
We may update these Terms from time to time. The effective date at the top shows when they last changed. Continuing to use the Site after a change means you accept the updated Terms.
